Federal Court Orders Freedom of Abrego Garcia from ICE Custody
A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken removal to El Salvador in March, which US authorities later admitted was an error. Following his repatriation to the United States to face human smuggling charges, he was detained in immigration custody.
In her order, the judge pointed out that the authorities lacks a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

The legal challenge involve conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.

The court, who was hearing his petition to deportation in a Maryland district court, determined that he must now comply with the terms of his release from custody in Tennessee. This decision effectively transfers his monitoring to the Tennessee court.
